In financial leasing, the lessee depreciates the asset, and expenses include depreciation and interest. VAT is also calculated differently: with operating leases, it is added to each payment, while with finance leases, it is paid on the entire amount at the beginning of the contract.

To sum it up

Accounting and depreciation: operational – from the lessor’s side; financial – from the user company’s side.

Expenses: Operating – full payment amount (with restrictions for passenger cars); financial – depreciation plus interest.

VAT: operational – in each individual payment; financial – one-time payment for the entire initial cost.

Refund It is possible in both forms; in financial terms, ownership usually passes to the user after the loan is repaid.

Below, we'll review the rules arising from Polish income tax (VAT and withholding tax) and VAT laws. This is a general overview; before signing the agreement, it's recommended to consult an accountant or tax advisor, as the details depend on the taxation method, the leased property, and the contract's content.

What is operating lease?

Operating lease Similar to a long-term lease with an option to purchase, the lessor (a financial institution) purchases the asset and leases it to the company for use for a fee. The leased asset remains on the lessor's fixed asset register, and the lessor makes depreciation charges.

For an agreement to be considered an operating lease for tax purposes, it must comply with the conditions of the income tax legislation (Article 17b of the Corporate Income Tax Act, Article 23b of the Income Tax Act), including:

The contract must be concluded for a fixed term of not less than 40% from the standard depreciation period object (for a passenger car - 24 months), and in the case of real estate - at least 10 years;

The amount of net fees agreed in the contract must correspond to at least the original cost of the goods.

The user includes in the total amount of the payment (principal and interest), as well as the down payment, are deductible. VAT is added to each payment, so there's no need to make an advance payment.

What is financial leasing?

Financial leasing works similarly to an installment plan. The leased asset is entered into the fixed asset register. tenant , which then depreciates it (Article 17f of the Corporate Income Tax Act, Article 23f of the Personal Income Tax Act). Once all payments have been made, ownership generally transfers to the lessee.

The company includes depreciation и interest Payments are treated as expenses. The capital portion is not an expense—it corresponds to the return of the cost of the goods, which is "returned" to expenses through depreciation. For VAT purposes, the supply of goods under a finance lease is considered a supply of goods, therefore VAT on the entire cost paid at the beginning of the contract (the current VAT payer can deduct it in accordance with the general rules).

Financial and operational leasing - comparison table

Characteristic

Operating lease

Financial leasing

Accounting of fixed assets

Landlord

User (tenant)

Who is devalued?

Landlord

User

User tax costs

Full payment in installments + down payment

Depreciation charges + interest on installments

VAT

Added to each part

From the total amount specified at the beginning of the contract.

Minimum contract term (for tax purposes)

40% from the standard depreciation period; real estate - 10 years.

There is no threshold value.

Ownership after completion of construction

It is possible to purchase for the amount agreed in the contract.

It is usually passed on to the user.

Similarity to

Long-term lease

Purchase in installments/on credit

Car Leasing - Cost Limits

The caps apply to passenger cars. For operating leases, the cap applies to the portion of the lease payment that corresponds to the vehicle's value, and for finance leases, it applies to depreciation charges. Effective January 1, 2026, the cap will be based on CO2 emissions:

100,000 zlotys – for vehicles with CO2 emissions of at least 50 g/km;

150,000 zlotys – for vehicles with CO2 emissions less than 50 g/km;

225,000 zlotys – for electric vehicles and hydrogen fuel vehicles.

If the value of a vehicle exceeds the limit, only a proportional portion is included in expenses. Transitional provisions apply to vehicles and contracts concluded between 2025 and 2026; it's worth checking with your accountant to determine their applicability. Separate rules also apply to VAT deductions for vehicles used for personal purposes.

Operating or financial leasing – which to choose?

The choice depends on the company's situation. Here are some practical tips:

Do you want to quickly reduce your income tax? – Operating leases often allow you to cover costs faster because they include both the full amount of payments and the down payment.

You have limited funds. In the operational case, you don't pay VAT upfront on the entire amount; in the financial case, you have to finance the project at the initial stage, even if you later deduct it from your tax base.

You plan to use the item for a long time and will treat it as your own from the start. – financial leasing is closer to purchase.

If you are not a current VAT payer or have a limited right to deductions, compare the VAT calculation procedure in both options.

Taxes are paid in one lump sum – expenses do not reduce the amount of tax, so the total amount to be paid is more important than tax optimization.

If you are planning to buy and sell this goods, consult your accountant about the tax implications of selling the goods you purchased.

It's also important to remember that the distinction between operating and finance leases in tax legislation doesn't always align with accounting treatment (for example, under the Accounting Act or IFRS 16). For a small company, the final choice is usually determined by the tax treatment, but larger companies must consider both options.

Frequently Asked Questions (FAQ)

Is it possible to purchase goods under an operating lease?

Yes. Operating leases typically provide for a purchase option at the end of the lease term for a specified amount. However, the purchase option is not mandatory and depends on the terms of the specific agreement.

Who depreciates the asset under a finance lease?

The user, that is, the company using the product, enters it into its fixed asset register and depreciates it, and also includes the percentage portion of the payments as expenses.

How is VAT paid in the field of financial leasing?

The delivery of goods is considered a supply of products, so VAT is charged on the entire value at the beginning of the contract. In operating leases, VAT is added to each payment.

What is the minimum term for a vehicle operating lease agreement?

For tax purposes, at least 40% is deducted from the standard depreciation period. For a passenger car, this is 24 months.

Which type of leasing is best for a sole proprietor?

There's no single answer. Operating leasing is a more common choice, as full payment is made in installments, including VAT, but the decision depends on the taxation method, the planned use of the asset, and financial liquidity. It's worth comparing both options with an accountant.

See also

What is the difference between renting and leasing?

What is the difference between leasing and long-term car rental?

What is the difference between a private apartment and a cooperative apartment?

What is the difference between a credit and a loan?

Financial leasing differs from operating leasing primarily in who depreciates the leased asset and how taxes are calculated: with operating leasing

[67,20
70
post-175768","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-vopros-otvet","category-fakty","tag-chem-otlichaetsya
["GET
